These Terms of Service ("Terms") govern your use of CampaignCNX+, a professional SMS campaign management platform operated by Hunter Creative Media & Design ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Acceptance of Terms

By accessing or using CampaignCNX+, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

CampaignCNX+ provides:

SMS and MMS campaign creation and broadcasting tools
Contact list management, import, and segmentation
Contact data hygiene tools (phone verification, DNC scrubbing, phone append)
Two-way messaging inbox
Campaign scheduling and delivery tracking
TCPA compliance tools and safeguards
Reporting and analytics

3. Account Registration

You must be at least 18 years old to create an account
You must provide accurate and complete registration information
You are responsible for maintaining the security of your login credentials
You must promptly notify us of any unauthorized access to your account
You are responsible for all activity that occurs under your account

4. Subscription and Billing

CampaignCNX+ offers multiple subscription tiers (Pay As You Go, Basic, Pro, Enterprise) with monthly and annual billing options.

New accounts receive a limited number of complimentary messaging credits to evaluate the platform
Subscriptions auto-renew at the end of each billing period unless cancelled
All fees are non-refundable except as stated in our Refund Policy
Cancellation takes effect at the end of the current billing period
Pay As You Go credits do not expire while your account remains active
Unused monthly credits roll over to the next billing period while your subscription is active

5. Acceptable Use

You agree not to use CampaignCNX+ to:

Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or state telemarketing regulations
Send unsolicited messages (spam) to individuals who have not provided proper consent
Send messages to numbers on the National Do Not Call Registry without a valid exemption
Transmit malware, phishing attempts, or fraudulent content
Harass, threaten, or abuse any person
Impersonate another person or organization
Collect personal information without proper consent or legal basis
Interfere with or disrupt the Service or its infrastructure
Resell or redistribute the Service without our written consent
Send messages that violate carrier acceptable use policies

6. TCPA and Messaging Compliance

You acknowledge and agree that:

You are solely responsible for obtaining proper consent from message recipients as required by the TCPA and applicable state laws
You will honor all opt-out requests promptly
You will only send messages during permitted hours (8:00 AM - 9:00 PM in the recipient's local time zone)
You will maintain records of consent for all contacts
You will include your organization's identification in messages as required by law
CampaignCNX+ provides compliance tools as a convenience, but you remain solely responsible for your compliance obligations

7. Intellectual Property

CampaignCNX+, including its design, features, and technology, is the property of Hunter Creative Media & Design and is protected by intellectual property laws. You retain ownership of content you create and upload to the platform, but grant us a limited license to host, store, and transmit that content as necessary to provide the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring that your use of the platform complies with applicable data protection laws.

9. Third-Party Services

CampaignCNX+ integrates with third-party services including SMS delivery providers, Stripe (payments), and others. We are not liable for the performance, availability, or policies of third-party services.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee specific delivery rates, open rates, or campaign outcomes.

11. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or TCPA fines resulting from your messaging practices.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hunter Creative Media & Design from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law including the TCPA.

13. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your account if you violate these Terms, engage in abusive messaging practices, or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Data may be retained as described in our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of the State of Illinois. Any disputes shall be resolved in the courts of DuPage County, Illinois.
